In short (plain-English summary)
You book by paying 100% upfront. That payment is a non‑refundable retainer that secures your date.
You get a 24‑hour sneak peek and your full edited gallery within 5 business days (Mon–Fri, Nassau time).
We deliver digital images (JPEG, full‑resolution) only. No RAWs for consumer sessions; commercial RAWs by separate license on request.
Galleries are password‑protected with a download PIN and stay online 30 days. Please download and back up.
Personal‑use rights are perpetual (including printing). Commercial or influencer/brand use requires a separate license.
Venues/permits/access fees are the client’s responsibility (tell concierge/marketing/security a private vendor will attend).
Local travel (Nassau & Paradise Island) is included; beyond that is quoted extra.
Cruise sessions: between 9:00–11:30 AM. Don’t book if your port time conflicts; notify us within 24 hours of any cruise schedule change. We offer a specific schedule guarantee (see below).
Lateness: 15‑minute grace, clock runs after; no‑show at 30 minutes, no refund/credit.
We aim to be fair and safe. If needed, we may adjust locations/timing for weather, safety, crowds, or venue rules.
(If anything below conflicts with your booking confirmation’s specific inclusions, the booking confirmation controls those specifics. Otherwise, these Terms control.)
1) Definitions
COMPANY: Al Rahming Photography.
CLIENT: the person who books and pays for the session.
Booking Confirmation: the email/receipt confirming your date/time, package inclusions, and any add‑ons. It is part of this Agreement.
Local: Nassau & Paradise Island.
Cruise Session Window: 9:00 AM – 11:30 AM (Nassau time).
2) Acceptance, Authority & Consent
Acceptance required to book. You cannot book unless you agree to these Terms. Checking the box and paying constitutes a binding e‑signature.
Authority & consent (all participants). The booking CLIENT is 18+ and has legal authority to bind every person photographed. For minors, CLIENT is the parent/guardian or has the parent/guardian’s written consent. For other adults, CLIENT has their permission.
Adult present for minors. At least one responsible adult must be present at all times during sessions involving minors.
Client responsibility. CLIENT is solely responsible for obtaining/keeping permissions/releases and will indemnify COMPANY against any claim arising from missing or invalid consent.
3) Booking, Payments, Currency & Taxes
100% upfront (non‑refundable retainer). To secure your slot, the entire session fee is due at booking. The payment functions as a non‑refundable retainer because we reserve that time and turn away other work. A session is not confirmed until payment is received.
Payment methods. Credit card, PayPal, or emailed invoice.
Currency. Prices are quoted and charged in USD; in‑person BSD is accepted at 1:1. Any bank/processor fees or FX charges are the client’s responsibility.
Taxes/VAT. We do not currently charge VAT. If the law later requires registration/collection, invoices will show VAT and totals will be updated accordingly.
Chargebacks & reversals. (i) If you’re unhappy, you agree to contact us by email or phone and allow up to 7 days to resolve before filing a chargeback. (ii) If any invoice is unpaid or charged back, all licenses/usage rights for those images are suspended until the account is brought current. (iii) Unsupported/frivolous chargebacks may incur a $50 admin fee to cover time/costs. (iv) We may use gallery/email/SMS logs as proof of delivery.
Prices. Prices vary by session and are as listed on the booking page at the time of booking.
4) Scheduling, Rescheduling, Lateness & Overtime
Client rescheduling. You may reschedule at any time at no fee, subject to availability.
Weather & venues. We may adjust start times or relocate for weather, safety, crowds, or venue/security. There’s no fee to adjust time or move locations, but third‑party costs (permits, passes, parking, transport) remain the client’s responsibility.
Lateness. 15‑minute grace. After 15 minutes, the session clock keeps running. At 30 minutes late, it is a no‑show and may be ended with no refund/credit. Late arrival does not extend the scheduled end time.
Overtime (on the spot). If you request extra time and we can accommodate it, overtime is $100 per 30 minutes, paid on‑site before we continue. Overtime extends shooting time only and does not guarantee extra deliverables.
5) Cruise Sessions (Schedule, Guarantee & Port‑Time Rules)
Window & eligibility. Cruise‑day sessions are scheduled between 9:00–11:30 AM (Nassau time). Do not book if your published port/shore time conflicts. If your cruise line changes your port time after booking, you must notify us by email (info@bahamas-photographer.com) within 24 hours and also call +1 (242) 426‑1039 for urgent coordination. Failure to notify on time may void the guarantee.
Schedule guarantee (our delay). We plan and run cruise sessions to finish with enough buffer for on‑time re‑boarding.
If our delay jeopardizes your on‑time re‑boarding (and it’s not due to client lateness, unreported/late‑reported port changes, venue/security holds, weather, or other conditions outside our control), you may elect a full refund.
If you actually miss your ship due solely to our delay, you will receive a full refund plus a complimentary reshoot on a future Nassau visit (subject to availability; third‑party costs like resort/permit/transport fees are excluded).
Exclusions. The guarantee does not apply to client lateness, unreported/late‑reported port‑time changes, changes by the cruise line/port authority, venue/security holds, severe weather, safety issues, or other conditions beyond our control.
6) Deliverables, Timelines, Format & Retouching
Source of truth. Your Booking Confirmation and the specific booking page control your session’s inclusions (time, locations, number/format of images, add‑ons). Marketing copy does not control. If there’s a difference, the Booking Confirmation controls.
Timelines. Sneak peek (5–10 images) within 24 hours. Full edited gallery within 5 business days (Mon–Fri, Nassau time), unless your Booking Confirmation states otherwise.
Format. Delivery is digital JPEGs, full‑resolution (as edited). Consumer sessions: no RAW/unedited files. Commercial: RAWs only by request, at our discretion, via separate paid license.
Retouching scope. Standard edits include exposure, color, crop/straighten, and minor skin cleanup (temporary blemishes). We do not include body reshaping, object removal, sky swaps, composites, or major alterations; these are paid add‑ons on request.
Included re‑edits. One (1) round of minor re‑edits on up to 10 delivered images if requested within 14 days of gallery delivery. Additional/advanced edits or extra rounds are billable.
7) Galleries, Security, Issue Window & Retention
Private by default. All galleries are password‑protected. We send the gallery link, password, and a temporary download PIN to the email used to book. PIN is required for downloads by default. We do not provide public/no‑password galleries.
Issue window. Report any download/access issues within 14 days of gallery delivery so we can help. Your included minor re‑edits must also be requested within 14 days.
Retention & deletion. Galleries remain online for 30 days from delivery. Please download and back up. After 30 days, we delete all files (edited and originals). Retrieval after deletion is not guaranteed.
Third‑party host. We use reputable third‑party platforms to deliver galleries and downloads. While we take security seriously, no system is 100% risk‑free.
8) Headcount, Pets & Service Animals
Default headcount. Unless your booking page/confirmation says otherwise, packages include up to 4 people. Children under 12 do not count toward this number. If your group exceeds a package’s limit, you must upgrade to a suitable tier; where no tier covers the group, an extra‑person fee of $50 per person applies.
Maximum without special arrangements. We accept groups up to 12 people; larger groups require a custom booking.
Pets & service animals. Pets are not allowed. Service animals are allowed where the venue permits and must be under control at all times.
9) Venues, Permits, Travel & Drones
Venue access & resort policies. For hotels/resorts/private properties, CLIENT is responsible for photographer access. As a courtesy, notify concierge, marketing, or security that a private vendor will be onsite for photography. If the venue requires day passes, wristbands, location fees, permits, parking, or imposes limits on props/tripods/drones/commercial‑looking gear, CLIENT accepts those limits and pays any fees. If access is denied or restricted, that is not COMPANY’s fault.
Permits & compliance. CLIENT secures required permissions/permits and follows venue rules. COMPANY may relocate or terminate a session for safety or compliance reasons. Additional time/relocation due to venue issues may incur charges.
Travel. Local coverage (Nassau & Paradise Island) has no travel fee. Travel beyond local (e.g., boat transfers to Rose Island/remote cays or paid‑entry locations) may incur quoted fees; CLIENT covers third‑party costs. If a package includes transport (e.g., VIP), then those transport costs are included as advertised.
Drones. We do not operate drones or offer aerial services.
10) Creative Discretion, Shot Lists & Conditions
Artistic style. By booking, you confirm you’ve reviewed our portfolio and trust our style and judgment. The final look is at our sole creative discretion.
Shot lists. Shot lists/mood boards are guidance only, not guarantees.
No specific‑shot guarantee. We can’t guarantee any particular image or look dependent on weather, crowds, venue access, construction, tides, sun position, or other factors outside our control.
Culling & editing. We select the best images and perform professional editing as defined above. Unedited/RAW files are not delivered for consumer sessions.
11) Rights, Licenses, Social Posting & Marketing Use
Copyright. COMPANY owns copyright to all images. No copyright is transferred unless agreed in writing.
Personal‑use license (perpetual). Upon full payment, CLIENT receives a perpetual, worldwide, non‑exclusive, royalty‑free license for personal use: viewing, downloading, backup, printing, sharing privately, and posting on personal (non‑commercial) social media.
Restrictions (personal use). No commercial/advertising use by any brand or third party; no sale/sublicensing/stock; no use implying endorsement.
Commercial & influencer use. Any use tied to a brand, product, service, sponsor, or compensation (money, free stays/gifts, promo codes, affiliate links, paid posts, whitelisting, tagging brands in a promotional context) is commercial and requires a separate written license with fees set by COMPANY. Retroactive licensing applies if commercial use occurs without a license.
Social credit & edits. On platforms that allow captions (e.g., Instagram feed, Facebook, X, LinkedIn), include visible credit: “Photo: Al Rahming Photography” and tag @alrahming where possible. Credit is appreciated, not required for ephemeral or caption‑less formats (e.g., Stories/Reels/TikTok without captions). Do not apply filters/AI edits/heavy alterations that materially change the delivered look. Basic crop/straighten/minor exposure tweaks are fine.
Print release. We provide a simple print release upon request so labs can fulfill personal prints. (We do not sell physical prints.)
Marketing use & model releases. Adult images may be used in our portfolio/marketing unless the adult opts out in writing (a reply to the booking email is fine). Minors are private by default; a parent/guardian may opt in in writing. Sensitive sessions (e.g., boudoir) require explicit permission even for adults. We honor reasonable takedown requests prospectively.
12) Conduct & Safety
Professional environment. Respectful conduct toward our team and others is required.
One warning. For harassment, abusive language, unsafe conduct, intoxication, illegal activity, or refusal to follow venue/security rules, we issue one clear warning.
Stop after warning. If issues continue—or anyone’s safety is at risk—we may stop immediately with no refund/credit. Weapons/contraband are not allowed. CLIENT is responsible for any damage caused by them or their guests.
13) AI Tools & Privacy Summary
Editing tools. We may use professional (including AI‑powered) tools for denoise, upscaling, and basic skin cleanup.
No AI training use. We do not use client images to train AI models, sell them as datasets, or permit facial recognition.
Privacy (brief). We collect basic booking info (name, email, phone, session details). We use it to run your session, deliver galleries/passwords/PINs, and provide support. Marketing messages are opt‑in only. Galleries live on reputable third‑party platforms and follow our 30‑day retention/deletion policy. 14) Force Majeure & Illness
Events beyond anyone’s control (e.g., hurricanes, severe weather, government orders, venue/security shutdowns, transport failures, power/network outages, accidents, sudden illness/injury) may prevent a session or delay delivery.
We will reschedule as soon as reasonably possible.
If rescheduling isn’t possible:
If the cause is not on our side (weather/venue/port changes), amounts paid remain a credit for 12 months.
If the cause is on our side and we cannot provide a qualified replacement and cannot reschedule, CLIENT may choose a refund or credit.
15) Cancellations, Credits & No‑Refund Policy
Non‑refundable retainer. The full fee paid at booking is a non‑refundable retainer.
Client cancellations (no reschedule). Amounts paid convert to a credit usable for any session within 12 months of the original date. Credit is non‑transferable, has no cash value, and rates/availability may change. Third‑party costs (permits/passes/transport) may be re‑charged.
Company cancellations. If we cancel and cannot provide a qualified replacement, applicable remedies in Force Majeure and Cruise Guarantee apply.
16) Limit of Liability
Cap. Our maximum total liability for any claim is limited to the non‑refundable retainer plus any amounts paid for that session.
No special damages. We are not liable for incidental, consequential, special, indirect, exemplary, or lost‑profit damages.
Exclusive remedies. Remedies listed in this Agreement (including Cruise Guarantee, Force Majeure, and Cancellations/Credits) are exclusive.
17) Dispute Resolution, Law & Venue
Mediation first. Before filing in court, parties must attempt good‑faith mediation in Nassau and share mediator/venue costs 50/50. If unresolved within 30 days of a written mediation request, either party may proceed in court.
Governing law & venue. This Agreement is governed by the laws of The Bahamas. Exclusive venue is in the courts of The Bahamas (Nassau).
Attorney’s fees. In any court action, the prevailing party may recover reasonable attorney’s fees and costs.
18) Communications & Notices
Transactional messages. By booking, you agree we may send transactional emails/SMS for confirmations, reminders, schedule updates, gallery links, passwords, and temporary download PINs. Marketing is opt‑in only.
Notices. Legal notices and cruise port‑time updates must be sent to info@bahamas-photographer.com. For urgent cruise changes, also call +1 (242) 426‑1039. Notices are deemed received when our email server accepts them; phone is for urgency and must be followed by email.
19) Order of Precedence & Version
Precedence. The Booking Confirmation controls specifics (date/time/location/package inclusions). These Terms control all other matters. If there is a direct conflict, these Terms win, unless the confirmation explicitly says otherwise in writing.
Version. The Terms in effect at the time of booking apply to your session. Later edits don’t change your booking unless agreed in writing.
20) Miscellaneous
Entire agreement. This Agreement (including your Booking Confirmation) is the entire understanding and supersedes prior discussions.
Assignment. We may assign to a trusted associate photographer; otherwise, no party may assign without written consent.
Severability & waiver. If any provision is unenforceable, the rest remains in effect. Failure to enforce is not a waiver.
Changes. We may update these Terms prospectively; the Last updated date will change accordingly (your booking keeps the version in effect when you booked).

Gallery window: Add “Galleries stay online for 30 days—please download and back up.”
Headcount: If a page is silent, the default is up to 4 people (kids under 12 don’t count).
No drones / no pets: Optional badges or bullets on relevant pages.
Cruise window: Show 9:00–11:30 AM and the 24‑hour port change notice.
5) Operational checklist (back‑office)
Update booking form to require checkbox acceptance of the Terms (e‑signature).
Ensure payment is taken at booking (100% upfront) across all funnels.
Confirm auto‑emails send gallery link, password, and temporary download PIN to the booking email.
Add issue‑window reminder (14 days) in delivery emails.
Add 30‑day gallery expiry line in delivery emails.
Add cruise change instructions (email + phone) to cruise confirmations.
Create a simple commercial licensing request path (form/email template).
Add overtime $100/30 min quick‑pay link for on‑site extensions.
Keep a takedown request email template for marketing opt‑outs.
6) Versioning
Version locked: These Terms apply to bookings made on/after Aug 11, 2025.
Prior bookings remain under the version in effect at their booking date.
